In a marriage, partners can draw up a joint, effective will , even if one of the partners does not add a date or place to their signature. This was decided by the Düsseldorf Higher Regional Court (AZ: 3Wx 55/16).

Accordingly, it is not important that both partners always sign with the date and place, but only that it is a joint, intentional declaration by both spouses. The mutual interest in the will must continue to exist at the time of the second signature. For reasons of proof, however, a will should always be dated by both spouses.
